This document sets forth the Terms of Use for the AcmeWeather.com website, the Acme Weather iOS application, and the Acme Weather Android application (the "Service") provided by Acme Weather Corporation, LLC ("Acme Weather"). Your access to or use of the Service constitutes your agreement to these Terms of Use.
Acme Weather reserves the right to terminate your access and/or take legal action for any violation of these terms.
Acme Weather respects the privacy of its users. Please refer to our Privacy Policy (https://acmeweather.com/privacy) which explains how we collect, use, and disclose information that pertains to your privacy.
Acme Weather hereby grants you a limited, non-exclusive, non-transferable license to access, use, and privately display the Service and its content for personal, non-commercial purposes only.
Your use of the Service is conditioned upon your agreement not to:
Acme Weather owns all rights, title, and interest in the Service, including without limitation, software, images, text, graphics, illustrations, logos, service marks, copyrights, photographs, videos, music, and all related intellectual property rights unless explicitly stated otherwise. Except as explicitly provided, you are prohibited from: (i) reproducing, modifying, reverse engineering, or creating derivative works; (ii) sell, license, sublicense, rent, lease, distribute, copy, publicly display, publish, adapt or edit the Service; or (iii) circumvent or disable any security or technological features of the Service.
Acme Weather may provide paid access to the Service through one-time or recurring subscriptions via authorized third party providers (“Marketplace Providers”). Payment requires a valid account with the Marketplace Provider and a current payment method. The Marketplace Provider, not Acme Weather, will process all payments. Payment-related inquiries must be directed to the Marketplace Provider. You are responsible for all charges incurred in connection with your payments.
By electing a subscription, you agree to pay the designated fee to the Marketplace Provider (“Subscription Fee”). Subject to the Free Trials and Promotional Offers section below, the first Subscription Fee will be charged to your Payment Method on the date the Marketplace Provider confirms your Subscription purchase. Subsequent Subscription Fees, along with any relevant taxes and service fees, will be billed by the Marketplace Provider on a recurring basis per your selected cycle.
Subscription Fees are payable at the commencement of the Subscription and on a recurring basis as per the established billing cycle, unless canceled. Billing is conducted by the Marketplace Provider, and cycles may vary. You are responsible for confirming the Marketplace Provider's billing policies before subscribing.
Each Marketplace Provider reserves the right to change the price for a Subscription to the Service in its sole discretion and will be responsible for communicating any price changes to you in accordance with the law.
You are obligated to maintain a current and valid Payment Method with the Marketplace Provider. Failure to do so, or any inability of the Marketplace Provider to process payment for Subscription Fees due to issues with your Payment Method, shall render you liable for said fees. Both the Marketplace Provider and Acme Weather reserve the right to suspend service access until a valid Payment Method is provided. Updates to your Payment Method may result in adjustments to your billing cycle.
You may cancel your Subscription at any time, but cancellation must occur before renewal to avoid charges for the next term. Cancellation is effective at the end of the current term. All cancellations must be made with the Marketplace Provider.
ALL SUBSCRIPTIONS ARE NON-REFUNDABLE. Acme Weather does not issue credits, refunds, or prorate billing for mid-term cancellations; access will continue to the billing cycle’s end. Marketplace Providers may, at their sole discretion, offer refunds or other considerations.
The Service may be available for a free trial period ("Trial Subscription"), with the specific duration detailed in the offer at the time of sign-up. Trial Subscriptions are generally limited to new subscribers, as determined by Acme Weather and the Marketplace Provider. These Terms of Use are applicable to any Trial Subscription, except as otherwise noted.
A valid Payment Method must be provided upon signing up for a Trial Subscription. While no charges will be applied during the trial, a preauthorization may be utilized.
UPON EXPIRATION OF THE TRIAL SUBSCRIPTION, THE STANDARD SUBSCRIPTION FEE WILL BE CHARGED TO YOUR PAYMENT METHOD UNLESS TIMELY CANCELLATION OCCURS. PLEASE NOTE THAT NO NOTIFICATION OF THE TRIAL SUBSCRIPTION'S END WILL BE PROVIDED.
For additional details about your Trial Subscription, including the end date, contact your Marketplace Provider.
Subsequent discounts or promotions will not affect your Subscription Fee. New customer promotions are limited to one instance per customer. Registering for the same promotional offer multiple times is a breach of these Terms and may lead to account termination.
Acme Weather may discontinue, suspend, terminate or block access to this Service at any time in its sole discretion. Acme Weather has no obligation to compensate you for any discontinuation, suspension, termination or blockage of access to this Service.
The Service may contain links to external websites. Acme Weather is not responsible for and does not control these websites or their content. Visiting these websites is at your own risk.
Should you initiate a legal claim against Acme Weather, you agree that such claim shall be exclusively filed and resolved in a state or federal court located within the State of Delaware. Further, you agree that the laws of the State of Delaware and, where applicable, the laws of the United States of America shall govern these Terms of Use and any legal disputes that may arise between you and Acme Weather, without regard to conflict of laws principles. You hereby consent to the personal jurisdiction of, and agree that venue is proper in, the courts located in the State of Delaware for any legal action or proceeding pertaining to Acme Weather or these Terms of Use.
Your utilization of the Service is undertaken at your sole risk. The Service is furnished on an “as is” and “as available” basis, and we explicitly disclaim all warranties, whether express or implied, encompassing but not restricted to implied warranties of merchantability, suitability for a specific purpose, and non-infringement. We provide no assurance that the Service will align with your requirements, or that it will be secure, uninterrupted, timely, precise, devoid of errors, or that your information will be protected.
Under no circumstances shall Acme Weather be held liable to you or any other party for any damages, including but not limited to direct, indirect, incidental, special, consequential, or exemplary damages, encompassing damages for loss of profits, goodwill, use, data, or other intangible losses, irrespective of whether Acme Weather was informed of the potential for such damages.
You shall indemnify, defend, and hold harmless Acme Weather, its owners, partners, affiliates, officers, directors, employees, related entities, and agents from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms of Use or your use of the Service. This indemnification extends to claims for personal injury or death, regardless of the legal theory under which such claims are brought, including but not limited to tort and negligence. This indemnification obligation shall survive the expiration, termination, or cancellation of this License.
This Agreement, comprised of these Terms of Use and any expressly incorporated documents, represents the entire understanding between you and Acme Weather regarding the subject matter hereof, and supersedes all prior agreements, understandings, and negotiations. Should any provision of these Terms of Use be determined to be invalid or unenforceable under applicable law or by a court of competent jurisdiction, such provision shall be construed in a manner consistent with applicable law to most closely effectuate the original intent of Acme Weather, while the remaining provisions of these Terms of Use shall remain in full force and effect. The failure of Acme Weather to exercise or enforce any right or provision of these Terms of Use shall not operate as a waiver of such right or provision. Any waiver of any right or provision must be in writing and signed by Acme Weather to be effective.
These Terms of Use are effective January 1, 2026.
These Terms of Use may be updated from time to time for any reason. We will notify you of any changes to our Terms of Use by posting the new Terms of Use here. You are advised to consult this Terms of Use regularly for any changes, as continued use is deemed approval of all changes.
